The Iran-United States Claims Tribunal is the most important source of international arbitral decisions for at least the past half century, and its decisions have contributed significantly to the development of international law and the law of international commercial transactions. Judge Aldrich, who is the only member of the Tribunal to have served since its inception in 1981, has written what will be recognised as the definitive book about the jurisprudence of the Tribunal. By combining normative philosophy and empirical social science, we craft a research framework for assessing differential expectations embodied in normative conceptions of the economic social contract in the United States. We argue that there are distinctviews of such a contract grounded in individualist and communitarian philosophical ideologies. We apply this framework to organizational downsizing, postulating that certain human resource practices, in combination with the respective ideological orientations, will affect perceptions of the justice of downsizing policies.Living up to one’s (...) word is a decisive measure of moral character. Within the microsocial realm of the family, promises and commitments derive their social force and cultural meaning from the idea that love or biology binds people together in an absolute way. But outside of this world, in the larger society, the only thing binding people together is a sense that there is a social contract, a set of common obligations held collectively by society as a whole. Fossil fuel divestment movements have gained momentum since 2011, aimed at ending fossil fuel use and a move toward a cleaner, affordable, and sustainable energy system, for business and society. The present study investigates the direct impact of fossil fuel divestment announcements on stock prices of firms listed on the United States' stock exchanges. Using an event study and guided by the United Nation's sustainable development goals (SDGs), we test the effects of 116 divestments announcements between 2014 (...) and 2019 on 51 publicly traded fossil fuel companies. Our results suggest that there is a negative effect of these announcements on fossil fuel firm stock prices. Also, we find that the type of fossil fuel firm (coal or oil and gas), the type of divestment (partial, coal only, or full), the timing of the announcement, and the size of the divesting investor have some explanatory power in relation to the (cumulative) abnormal returns following the divestment announcements. While the negative impact on stock prices is not surprising, the reaction from the divested firms after such large divestitures is not consistent with what may be expected, given past reactions to divestitures seeking to achieve different social goals. Given the SDGs, it seems clear why investors are divesting themselves from fossil fuel firms, but why has the reaction to the 116 divestments led to very little change in the way these publicly traded fossil fuel firms do business given their direct and growing impacts on society? We conclude the study with some suggestions for future research. (shrink)

A leading figure in cultural studies worldwide, Néstor García Canclini is a Latin American thinker who has consistently sought to understand the impact of globalization on the relations between Latin America, Europe, and the United States, and among Latin American countries. Europe's leading existential thinkers -- Jean-Paul Sartre, Simone de Beauvoir, and Albert Camus -- all felt that Americans were too self-confident and shallow to accept their philosophy of responsibility, choice, and the absurd. "There is no pessimism in America regarding human nature and social organization," Sartre remarked in 1950, while Beauvoir wrote that Americans had no "feeling for sin and for remorse" and Camus derided American materialism and optimism. Existentialism, however, enjoyed rapid, widespread, and enduring popularity among Americans. In Existential America , historian George Cotkin argues that the existential approach to life, marked by vexing despair and dauntless commitment in the face of uncertainty, has deep American roots and helps to define the United States in the twentieth-century in ways that have never been fully realized or appreciated. Franz Boas, the major founding figure of anthropology as a discipline of America, came to the United States from Germany in 1886. Though this fact is widely known, the significance of Boas' roots in German intellectual tradition and late nineteenth century German anthropology remains obscure. As European colonies in Asia and Africa became independent nations, as the United States engaged in war in Southeast Asia and in covert operations in South America, anthropologists questioned their interactions with their subjects and worried about the political consequences of government-supported research. By 1970, some spoke of anthropology as “the child of Western imperialism” and as “scientific colonialism.” Ironically, as the link between anthropology and colonialism became more widely accepted within the discipline, serious interest in examining the (...) history of anthropology in colonial contexts diminished. This volume is an effort to initiate a critical historical consideration of the varying “colonial situations” in which (and out of which) ethnographic knowledge essential to anthropology has been produced. The essays comment on ethnographic work from the middle of the nineteenth century to nearly the end of the twentieth, in regions from Oceania through southeast Asia, the Andaman Islands, and southern Africa to North and South America. Keywords: A theological approach to understanding time and change in a modern way must consider the relationships between thermal physics and time as elucidated during the past century and a half. The fact of temporal change, including death and decay, has been a religious problem since antiquity, so that some traditions have simply attempted to transcend the world of change. However, a major current of the Christian tradition has seen change as a fundamental aspect of God's creation, and one with (...) which God becomes identified in the Incarnation. This implies approval of history, as having an ultimate value, rather than transcendence of it.We examine thermodynamics, and especially its Second Law, in order to understand more precisely the issues of temporal change. The Second Law states a universal tendency toward increasing disorder, and several implications of this law are discussed. Of particular significance, however, is the work of Prigogine and others on nonequilibrium thermodynamics, drawing attention to such phenomena as the enhancement of chemical reaction rates and the formation of “dissipative structures” in nonequilibrium situations. Such possibilities may be of considerable importance for understanding chemical and biological evolution.These ideas can be included in an evolutionary picture in which, following Teilhard de Chardin, the Body of Christ is seen as the future of evolution‐an “ultimate dissipative structure” in which the world of time and change is united with God. Suffering, death, and decay receive their meaning from the future. Within this framework it is therefore possible to believe that the material world of history may be part of the eschatological future and that science provides hints, though not predictions, of how that may happen. In the United States people of Middle Eastern descent are legally/politically categorized as white, but in social encounters and popular representations Middle Eastern people are treated as a nonwhite inferior collective. In the absence of explicit systemic recognition through a protected class status, Middle Eastern Americans are not just vulnerable to the social-systemic violence that accompanies racialization; that violence is being tacitly permitted. I address this problem by describing the historical and political conditions that afford this racialization in (...) the United States. I argue that the racialization of Middle Easterners, best understood from a historical perspective, is rooted in the repetitive treatment of certain peoples as objects of war to be degraded, exploited, dominated, and destroyed. To be treated as inferior and disposable is a general function of racism, which is afforded by racialization; but, the historical conditions of the mistreatment of Middle Eastern peoples create a unique set of problems and tensions that assign specific meanings which must be addressed in combating racism. Included among these tensions is a problematic narrative that claims Middle Eastern peoples are an almost naturally warlike and thus fragmented collective. The problem of disunity results from being created and treated as objects of war. Thus, social recognition, or solidarity, is needed along with systemic recognition. As a more effective means of countering the repetitious practices of subjugation, I plea for a solidarity among Middle Eastern Americans in response to Orientalist-racist scripts that claim disunity and war are the preferred condition of Middle Eastern peoples. Prof. Lodge explores the use of ideology as a concept to understand ethical issues. He observes an ideological transition occurring in the United States, one that has been under way for some 80 years from what he refers to as Individualism to Communitarianism. Many ethical questions depend for an answer on which ideology is dominant or which is appropriate.

This study reports the results of a survey of 405 high school students in a school district in the western United States. The data were used to determine why so many students take only the minimal science required for graduation. Key areas addressed included how science is taught; science literacy; science, technology, engineering and mathematics (STEM); science, technology, and society (STS); and who influences students to take science. Results were directed at how to motivate more students to continue (...) science study beyond the required courses and how to improve the prospect of more students choosing STEM majors in higher education. Key conclusions included that no new science courses are needed to increase enrollments, but existing courses need to be taught differently, specifically with more labs and activities that create more interest and relevance for students. Furthermore, students need more awareness of good reasons for taking science. Last, science instruction must improve. (shrink)
